US Judge Dismisses Defamation Case Against Former FBI Official

(MENAFN) According to reports, a federal judge has dismissed a defamation lawsuit filed by Kash Patel against former FBI official and commentator Frank Figliuzzi, concluding that the remarks in question were protected under free speech and did not meet the legal threshold for defamation.

The case centered on statements made by Figliuzzi suggesting that Patel spent more time in nightclubs than at FBI headquarters. Patel argued that the claim harmed his reputation and amounted to a false statement presented as fact.

In the ruling, George Hanks determined that the comments did not constitute defamation, emphasizing their exaggerated nature.

"The Court finds that Figliuzzi’s statement is rhetorical hyperbole that cannot constitute defamation. Accordingly, Dir. Patel has failed to state a claim against Figliuzzi, and his lawsuit must be dismissed," US District Court Judge George Hanks wrote in the decision.

“The Court finds that Figliuzzi’s statement, when taken in context, cannot have been perceived by a person of ordinary intelligence as stating actual facts about Patel.”

"A person of reasonable intelligence and learning would not have taken his statement literally: that Dir. Patel has actually spent more hours physically in a nightclub than he has spent physically in his office building.”

The judge further explained that by claiming Patel spent “far more” time in nightclubs, Figliuzzi was speaking in an exaggerated and provocative manner rather than making a factual allegation.

Additionally, the court ruled that Figliuzzi is not entitled to recover legal fees or court costs under Texas’ anti-SLAPP law.

This case is separate from another lawsuit in which Patel is seeking $250 million in damages from The Atlantic over allegations related to his reported alcohol use—claims he has publicly denied.

"I've never been intoxicated on the job, and that is why we filed a $250 million defamation lawsuit. And any one of you that wants to participate, bring it on. I'll see you in court," Patel told reporters.
